Walking L™ is a DBA of Jay Lowe Consulting LLC. Jay Lowe Consulting LLC owns and operates Walking L™ and owns the applicable Walking L™ business assets and intellectual property.

Terms of Service

Welcome to Walking L™ (“Walking L,” “we,” “our,” or “us”). Walking L™ is a collaborative shopping-list application that allows users to create, manage, share, and collaborate on shopping lists and use related shopping, store, location, notification, and subscription features.

These Terms of Service (“Terms”) govern your access to and use of Walking L™.

By creating an account, accessing, purchasing through, subscribing to, or using Walking L™, you agree to these Terms. If you do not agree to these Terms, do not use Walking L™.

Eligibility

You must be at least 13 years old to use Walking L™.

If applicable law requires parental or legal-guardian consent for you to use Walking L™ or for your personal information to be processed, you may use Walking L™ only after the required consent has been obtained.

Your Account

You are responsible for maintaining the security of your account and for activity occurring through your account to the extent reasonably within your control.

You agree to provide accurate information where required and not to impersonate another person, misrepresent your identity, or knowingly provide false account information.

You should promptly contact Walking L™ if you believe your account has been accessed or used without authorization.

Shared Lists and User Content

Walking L™ allows users to create, join, manage, and participate in shared shopping lists.

You are responsible for content you create, submit, share, or manage through Walking L™, including usernames, display names, list names, shopping items, store information, and other user-generated content.

Information intentionally placed in a shared list may be visible to other authorized participants in that list. Depending on their role and permissions, other authorized participants may be able to add, modify, remove, or otherwise interact with shared-list information.

You should not place sensitive personal information in a shared list that you do not want other authorized participants to see.

You retain ownership of content you provide to Walking L™. You grant Jay Lowe Consulting LLC a limited, non-exclusive right to host, process, transmit, display, synchronize, and otherwise use that content as reasonably necessary to provide, maintain, secure, and operate Walking L™.

Walking L™ does not endorse user-generated content and, to the maximum extent permitted by applicable law, Jay Lowe Consulting LLC is not responsible for disputes between users or actions taken by authorized participants within shared lists.

Acceptable Use

You may not use Walking L™ to:

Engage in unlawful, fraudulent, threatening, harassing, abusive, deceptive, or otherwise prohibited conduct.
Violate the rights of another person.
Upload, submit, or distribute unlawful or infringing content.
Impersonate another person or misrepresent your identity.
Attempt to gain unauthorized access to another user’s account, data, lists, systems, or services.
Interfere with, disrupt, damage, probe, test, or compromise the operation or security of Walking L™ or systems used to provide the service.
Introduce malicious software, code, or other harmful material.
Abuse Walking L™ in a manner that materially interferes with another user’s use of the service.
Use Walking L™ for purposes prohibited by applicable law.

Circumvention of Payments, Subscriptions, Limits, and Access Controls

You may not bypass, circumvent, manipulate, disable, exploit, or otherwise interfere with Walking L™ subscription requirements, payment systems, subscription validation, usage limits, service limits, access controls, security measures, or other mechanisms intended to control or restrict access to features or services.

Attempting to obtain paid features, higher service levels, increased limits, or other restricted functionality without valid authorization or payment constitutes a violation of these Terms.

Walking L™ may restrict affected features, revoke unauthorized access, restrict or suspend an account, terminate an account, or take other reasonable action when Jay Lowe Consulting LLC reasonably determines that an account has obtained or attempted to obtain unauthorized access to paid or restricted functionality.

Where appropriate, users may contact Walking L™ Support if they believe an account restriction or suspension was made in error.

Investigations and Enforcement

To the extent permitted by applicable law, Jay Lowe Consulting LLC may preserve, review, and use information reasonably necessary to detect, investigate, document, prevent, or respond to suspected unauthorized access, security incidents, fraud, abuse, payment or subscription circumvention, violations of these Terms, or other prohibited or unlawful activity.

Information reasonably necessary for these purposes may be preserved after an account is restricted, suspended, terminated, or deleted where permitted by applicable law.

Jay Lowe Consulting LLC may cooperate with valid legal process and lawful requests from courts, regulators, law-enforcement agencies, or other authorized governmental authorities.

Nothing in these Terms requires Jay Lowe Consulting LLC to disclose security methods, investigation procedures, fraud-detection methods, proprietary technology, or other information that could compromise the security, integrity, or operation of Walking L™.

Enforcement, Account Restrictions, Suspension, and Termination

Jay Lowe Consulting LLC reserves the right to remove content, restrict functionality or access, remove users from shared lists where appropriate, suspend accounts, terminate accounts, or take other reasonable action when reasonably necessary to:

Enforce these Terms.
Protect Walking L™ or its users.
Address suspected fraud, abuse, unauthorized access, or security incidents.
Address unauthorized access to paid or restricted functionality.
Protect Walking L™ systems, intellectual property, or business assets.
Comply with applicable law or valid legal process.
Prevent material harm to Jay Lowe Consulting LLC, Walking L™, our users, or others.

Where appropriate and reasonably practicable, Walking L™ may provide information about an account restriction and a means to contact Support.

Suspension or termination may result in loss of access to Walking L™, shared lists, account information, paid functionality, or other features, subject to applicable law and applicable application-store requirements.

Purchases and Refunds

Except where otherwise required by applicable law or the policies of the platform through which a purchase was made, purchases and subscription charges are non-refundable.

Purchases made through the Apple App Store, Google Play, or another authorized payment platform are also subject to that platform’s applicable billing, cancellation, and refund terms and policies.

Jay Lowe Consulting LLC does not independently control whether Apple, Google, or another payment provider approves a refund requested through that provider.

Nothing in these Terms limits any refund, cancellation, or consumer right that cannot lawfully be limited or waived.

Subscriptions and Payments

Walking L™ may offer optional paid features, subscriptions, service levels, or increased usage limits.

Applicable subscription pricing, duration, features, and other purchase information will be presented through the applicable purchase process.

Subscriptions may automatically renew unless canceled in accordance with the applicable application store’s or payment provider’s procedures and terms.

Purchases made through mobile application stores are processed by the applicable platform, such as the Apple App Store or Google Play. Pricing, billing, renewal, cancellation, refunds, payment processing, and related matters may therefore also be governed by that platform’s terms and policies.

Walking L™ and Jay Lowe Consulting LLC do not directly collect or store complete payment-card information for transactions processed by an application store or other authorized payment provider.

Access to paid features may depend upon confirmation of a valid subscription or entitlement from the applicable payment or application-store system.

Features, limits, pricing, subscription offerings, and service levels may change over time subject to applicable law and applicable application-store requirements. Applicable pricing and subscription terms will be presented before purchase where required.

Cancellation of a subscription prevents future renewal as provided by the applicable platform but does not necessarily entitle the user to a refund for a previously completed charge.

Location-Based Features

Walking L™ may provide location-based features, store-related functionality, and nearby-store notifications for convenience.

Location information, geofencing, and location-based notifications may be delayed, inaccurate, unavailable, or may not occur due to factors outside Jay Lowe Consulting LLC’s reasonable control, including device hardware, device settings, location permissions, operating-system restrictions, network connectivity, GPS accuracy or availability, background-processing restrictions, battery-management settings, third-party services, or other technical conditions.

Location-based notifications are provided as a convenience and are not guaranteed.

You should not rely upon Walking L™ location functionality or notifications for emergencies, personal safety, time-critical matters, or circumstances in which failure, delay, or inaccuracy could result in significant harm.

You remain responsible for your shopping activities, lists, purchases, and reminders regardless of whether a location-based notification is received.

Notifications

Walking L™ may provide notifications and alerts relating to app functionality.

Notifications may be delayed, suppressed, duplicated, or not delivered due to device settings, operating-system behavior, network availability, third-party notification services, permissions, or other circumstances outside Jay Lowe Consulting LLC’s reasonable control.

Walking L™ does not guarantee delivery or timing of any notification.

Service Availability and Changes

Walking L™ may modify, update, limit, suspend, replace, or discontinue features or portions of the service when reasonably necessary.

Walking L™ does not guarantee that every feature will remain available indefinitely or operate identically across every device, operating system, platform, geographic location, or application version.

Service availability may be affected by maintenance, software updates, internet connectivity, outages, third-party services, application-store services, cloud infrastructure, device limitations, security measures, or circumstances outside Jay Lowe Consulting LLC’s reasonable control.

Where required by applicable law or application-store requirements, material changes affecting a paid service will be handled in accordance with those requirements.

Third-Party Services

Walking L™ relies on third-party platforms, infrastructure, services, and technology to provide certain functionality. These may include application stores, authentication providers, cloud infrastructure, mapping and location services, notification systems, operating-system providers, and other service providers.

Jay Lowe Consulting LLC does not control the independent operation, availability, policies, security, or actions of third-party services.

To the maximum extent permitted by applicable law, Jay Lowe Consulting LLC is not responsible for interruptions, limitations, changes, or failures caused by third-party services outside its reasonable control.

Your use of third-party services may also be subject to the terms and policies of those providers.

Data, Lists, and Service Records

Walking L™ uses reasonable measures designed to maintain the availability and integrity of information necessary to operate the service.

However, Walking L™ is not intended to serve as a permanent archival, backup, recordkeeping, emergency, or data-storage service.

To the maximum extent permitted by applicable law, Jay Lowe Consulting LLC does not guarantee that every shopping list, item, store, preference, notification, or other record will be preserved indefinitely or recoverable under every circumstance.

Users should not use Walking L™ as the sole repository for information whose permanent preservation is essential.

Privacy

Your privacy is important to us.

Walking L™’s collection, processing, sharing, retention, security, and deletion of personal information is described in the separate Walking L™ Privacy Policy.

The Privacy Policy includes information concerning account information, shared-list information, location information, notifications, subscription information, third-party services, security and fraud prevention, investigations, data retention, and account deletion.

The Privacy Policy should be reviewed together with these Terms.

Account and Data Deletion

You may request deletion of your Walking L™ account through the account-deletion functionality provided by Walking L™ or through the account-deletion resource available on the Walking L™ website.

Before deleting your account, you should transfer ownership of shared shopping lists where applicable. Deleting your account may result in loss of access to lists you created, manage, or participate in.

When an account is deleted, personal information associated with that account will be deleted or de-identified as applicable, subject to information Jay Lowe Consulting LLC is required or permitted to retain.

Walking L™ may retain historical, aggregated, or de-identified information that is no longer reasonably associated with an identifiable user.

Jay Lowe Consulting LLC may also retain information where reasonably necessary and permitted by applicable law for security, fraud prevention, investigation of unauthorized access or payment/subscription circumvention, legal compliance, transaction-related obligations, dispute resolution, enforcement of agreements, or the establishment, exercise, or defense of legal claims.

Contact-assisted deletion requests are typically processed within 30 days.

Intellectual Property and Ownership

Walking L™, including its software, source code, object code, technology, systems, designs, interfaces, graphics, logos, branding, documentation, content created by or for the company, and other applicable intellectual property and business assets, is owned by Jay Lowe Consulting LLC or, where applicable, used by Jay Lowe Consulting LLC under appropriate license.

Jay Lowe Consulting LLC owns the Walking L™ business and its applicable intellectual property, assets, and proprietary rights, subject to rights belonging to third parties in third-party software, services, content, trademarks, or other materials.

Walking L™ and JLC GLOBAL are DBAs of Jay Lowe Consulting LLC. Use of either trade name does not create a separate legal entity or transfer ownership of intellectual property or assets away from Jay Lowe Consulting LLC.

Except for the limited right to access and use Walking L™ in accordance with these Terms, no ownership, license, title, or other proprietary right in Walking L™ or its intellectual property is transferred to you.

Users retain ownership of content they provide to Walking L™. Users grant Jay Lowe Consulting LLC the limited rights reasonably necessary to host, process, transmit, display, synchronize, and otherwise use that content for the purpose of providing, maintaining, securing, and operating Walking L™.

Walking L™ and associated names, logos, branding, and other proprietary materials may not be copied, reproduced, distributed, modified, or used in a manner that suggests sponsorship, endorsement, affiliation, or authorization without permission, except as otherwise permitted by applicable law.

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WALKING L™ AND THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

JAY LOWE CONSULTING LLC DISCLAIMS WARRANTIES, REPRESENTATIONS, AND CONDITIONS, WHETHER EXPRESS, IMPLIED, OR STATUTORY, TO THE EXTENT THEY MAY LAWFULLY BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

JAY LOWE CONSULTING LLC DOES NOT WARRANT THAT WALKING L™ WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR FREE FROM DELAYS, DEFECTS, DATA LOSS, OR OTHER TECHNICAL ISSUES.

JAY LOWE CONSULTING LLC DOES NOT GUARANTEE THE ACCURACY, AVAILABILITY, OR DELIVERY OF LOCATION INFORMATION, GEOFENCING, NOTIFICATIONS, SHARED-LIST SYNCHRONIZATION, OR OTHER FEATURES.

NOTHING IN THESE TERMS EXCLUDES WARRANTIES, GUARANTEES, OR OTHER RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JAY LOWE CONSULTING LLC AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE WALKING L™, INCLUDING LOSS OF DATA, LOSS OF USE, LOST PROFITS, OR BUSINESS INTERRUPTION, TO THE EXTENT SUCH DAMAGES MAY LAWFULLY BE LIMITED OR EXCLUDED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JAY LOWE CONSULTING LLC WILL NOT BE RESPONSIBLE FOR LOSS OR DAMAGE RESULTING FROM MATTERS OUTSIDE ITS REASONABLE CONTROL, INCLUDING THIRD-PARTY SERVICE FAILURES, NETWORK OR DEVICE FAILURES, OPERATING-SYSTEM RESTRICTIONS, INACCURATE OR UNAVAILABLE LOCATION INFORMATION, NOTIFICATION FAILURES, OR ACTIONS TAKEN BY OTHER AUTHORIZED SHARED-LIST PARTICIPANTS.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY WHERE SUCH LIABILITY CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Jay Lowe Consulting LLC and its officers, employees, contractors, and agents from third-party claims, liabilities, damages, losses, and reasonable costs arising from your unlawful misuse of Walking L™, your violation of these Terms, your infringement of another person’s rights, or content you provide through Walking L™, except to the extent the claim results from conduct for which Jay Lowe Consulting LLC is legally responsible.

Changes to These Terms

Jay Lowe Consulting LLC may update these Terms from time to time to reflect changes to Walking L™, the business, applicable law, application-store requirements, security needs, or other operational requirements.

The Effective Date will be updated when these Terms are revised.

Where required by applicable law, additional notice or consent will be provided before material changes become effective.

Continued use of Walking L™ following an applicable change constitutes acceptance of the revised Terms to the extent permitted by applicable law.

Entire Agreement and Severability

These Terms, together with the Walking L™ Privacy Policy and any additional terms expressly presented in connection with a particular feature, purchase, or subscription, constitute the applicable agreement concerning your use of Walking L™, subject to rights or obligations that cannot be modified by agreement under applicable law.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law, and the remaining provisions will continue in effect.

Failure by Jay Lowe Consulting LLC to enforce a provision of these Terms does not waive the right to enforce that provision later.
